Terms of Service

1. Acceptance of Terms

By accessing or using AccommodoHub ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users including students, faculty, staff, and administrators. If you do not agree to these terms, please do not use our services.

2. Description of Service

AccommodoHub provides a cloud-based software platform for managing academic accommodations in higher education institutions. The Service includes:

• Accommodation request and approval workflow management
• Faculty notification and implementation tracking
• Exam scheduling with accommodation support
• Document management for medical records
• Compliance reporting and audit logging
• LMS integration capabilities

3. User Responsibilities

3.1 All Users

• Maintain confidentiality of login credentials
• Use the system only for authorized purposes
• Report any security concerns immediately to your institution's DRC
• Comply with FERPA and institutional policies
• Provide accurate and truthful information
• Not attempt to access records of other users without authorization

3.2 Institutional Administrators

• Ensure users are properly trained on FERPA requirements
• Manage user access and permissions appropriately
• Maintain accurate institutional data
• Report data breaches within 24 hours

4. Institutional Licensing

Access to AccommodoHub is provided through institutional licensing agreements:

• Subscription Term: Annual subscriptions with automatic renewal unless cancelled 60 days prior to expiration
• User Limits: Unlimited users within the subscribing institution
• Data Ownership: All institutional data remains the property of the institution
• Data Portability: Institutions may export all data at any time in standard formats

5. Service Availability

• Uptime Target: 99.9% availability during academic year
• Maintenance Windows: Scheduled maintenance performed during low-usage periods with advance notice
• Support Response: Critical issues addressed within 4 hours; standard issues within 24 hours

6. Data Processing Agreement

By using the Service, institutions agree to the following data processing terms:

• AccommodoHub processes data solely on behalf of the institution
• Data is processed only for purposes specified in the Privacy Policy
• Sub-processors are bound by equivalent data protection requirements
• AccommodoHub will assist with data subject requests as required by law

7. Intellectual Property

• AccommodoHub retains all rights to the Service software and technology
• Institutions retain all rights to their data
• Users may not reverse engineer, copy, or redistribute the Service

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• AccommodoHub's total liability shall not exceed the annual subscription fee paid by the institution
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for damages arising from third-party integrations
• Institutions remain responsible for their own FERPA compliance decisions

9. Indemnification

Institutions agree to indemnify AccommodoHub against claims arising from:

• Misuse of the Service by institutional users
• Violation of FERPA by institutional users
• Inaccurate data provided by the institution

10. Termination

• Either party may terminate with 60 days written notice
• Upon termination, institutions may export all data within 90 days
• AccommodoHub will delete all institutional data within 30 days of the export period

11. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Suffolk County, Massachusetts.

12. Modifications

We may modify these Terms with 30 days advance notice. Continued use after the effective date constitutes acceptance. Material changes will be communicated via email to institutional administrators.
